Personal data we process, why, and on what legal basis

We process personal data on a purpose-by-purpose basis as follows:

  • Responding to enquiries (name, email, telephone, company, country, content of the enquiry). Legal basis: pre-contractual measures taken at the request of the data subject (Art. 6(1)(b) GDPR) and, where applicable, consent (Art. 6(1)(a)).
  • Providing legal services upon engagement (identification, contact, professional and matter-related data). Legal basis: performance of a contract (Art. 6(1)(b)).
  • Complying with legal obligations, including client identification and anti-money-laundering obligations and professional record-keeping. Legal basis: compliance with a legal obligation (Art. 6(1)(c)).
  • Sending professional communications about the firm’s practice areas. Legal basis: consent (Art. 6(1)(a)) where required, or the firm’s legitimate interest in maintaining professional contact with existing clients and contacts (Art. 6(1)(f)). Where we rely on legitimate interest, our interest is limited to direct professional communication with parties who have an existing relationship with the firm, balanced against the rights and expectations of the data subject; the data subject may object at any time.

Provision of data

Providing the data requested in the contact form or in the course of an engagement is not a statutory obligation, but it is necessary in order to respond to the enquiry or to provide the requested services. If the data is not provided, we may be unable to respond or to act.

Withdrawal of consent

Where processing is based on consent, the data subject may withdraw that consent at any time, without affecting the lawfulness of processing carried out before withdrawal, by writing to privacy@ipglobalguard.com.

Automated decision-making

We do not carry out automated decision-making or profiling that produces legal effects or similarly significantly affects the data subject.

Recipients and processors

Personal data is processed by authorised personnel of META Channel Corporation Limited. Where required to provide legal services, data may be shared with qualified correspondent counsel and agents within the firm’s network, and with service providers acting as data processors (for example, hosting, email and IT providers) under data processing agreements. Data is not sold or transferred to third parties for their own commercial purposes.

Data hosting and international transfers

The website and its data are hosted on servers located within the European Union (Spain). Where personal data is transferred outside the European Economic Area in the course of providing legal services across multiple jurisdictions, such transfers are made on the basis of an adequacy decision, standard contractual clauses or other appropriate safeguards under Chapter V of the GDPR.

Data retention

Enquiry data not resulting in engagement: retained for a maximum of twelve months. Client matter data: retained for the duration of the engagement and thereafter for the period required by applicable legal, regulatory and professional record-keeping obligations. After the applicable period, data is deleted or anonymised.

Rights of the data subject

The data subject has the right to access, rectify, erase, restrict, port and object to the processing of personal data, and to withdraw consent where processing is based on it. The data subject may lodge a complaint with the Data Protection Commission (DPC) of Ireland and, where applicable, with their own national supervisory authority, including the Agencia Española de Protección de Datos (AEPD) for residents in Spain. To exercise these rights, contact privacy@ipglobalguard.com.

Modifications

META Channel Corporation Limited reserves the right to modify this Privacy Policy at any time. Modifications take effect upon publication on this website.
