To use it, the mark must be recorded in the Trademark Clearinghouse (TMCH) and you need the Signed Mark Data (SMD) file the TMCH issues. This guide explains what a block covers, what it leaves open and when it costs less than registering defensive domains one by one.

Key takeaways

DPML blocks the exact match of a mark recorded in the TMCH across Identity Digital’s extensions; it does not cover misspellings or other registries such as .com or country codes.

The standard (legacy) DPML does not block premium names; DPML Plus does. No version blocks sunrise registrations.

Any holder of an identical mark with a valid SMD file can override your block and register the name.

The TMCH charges USD 155 per record per year when paid by card, which is the entry ticket to DPML and most other blocking products.

DPML usually pays off when your defensive list would include many Identity Digital extensions with no business use.

What is the Domains Protected Marks List?

Identity Digital (formerly Donuts) operates a large group of new generic extensions. On its registrar products page it describes DPML as a service that “defensively blocks registrations of trademarked brands” across its portfolio, and refers elsewhere on the same page to a portfolio of nearly 300 TLDs. Once the block is in place, matching names in those extensions are reserved and only the trade mark holder can register them.

A block is ordered through an accredited registrar, for a minimum term of one year, by uploading the SMD file; the registrant details must match those in the file, as Identity Digital explains in its help article on purchasing a block. Anyone can check whether a label is blocked: a WHOIS lookup on an Identity Digital extension returns a notice that the name is blocked because the string is a trade mark.

What do you need to block a mark?

Three things, in this order:

A qualifying mark. The TMCH accepts word marks registered with national or regional effect, marks protected by statute or treaty and court-validated marks. Applications are not accepted. A Madrid international registration qualifies only while its basic national registration is valid, or once the international registration is more than five years old (TMCH, registered trademarks).

A verified TMCH record with proof of use. You submit the registration details, a specimen showing use and a signed declaration. Once verified, the SMD file can be downloaded, according to the TMCH, within an hour at most.

An identical match. Identity Digital’s Sunrise and DPML Dispute Resolution Policy defines it as a label made up of the complete and identical textual elements of the mark. For logos, only predominant word elements that are clearly separable from the device count.

The same SMD file also gives access to other registries’ blocking products. The TMCH’s blocking page lists GlobalBlock, AdultBlock, AdultBlock+, DPML, NameBlock and ShortBlock.

DPML or defensive registration: which costs less?

Identity Digital does not publish DPML retail prices on these pages; registrars quote them. The useful comparison is therefore structural:

Option

What it protects

Fixed costs

Fits best when

Defensive registrations

Only the names you register, in any extension

One registration and renewal per name

A short list of extensions you may actually use

DPML (legacy)

Exact match in Identity Digital extensions, except premium names

TMCH record plus one block per label

Many Identity Digital extensions with no business use

DPML Plus

As above, including premium names

TMCH record plus a higher-tier block

Marks that are also common words likely to be premium

TMCH record alone

Sunrise access and claims notices in all new gTLDs; no block

USD 155 a year, USD 465 for three years or USD 775 for five, by card

Brands that prefer monitoring plus selective registrations

The TMCH figures come from its card payment page and its pricing overview, which also offers prepaid structures for holders and agents. In practice, the calculation is simple: count the Identity Digital extensions you would otherwise register only to keep them away from others, multiply by the renewal cost and compare it with the TMCH fee plus the DPML quote. Keep registering the names you will actually use: a block gives you no website or email.

What does DPML not cover?

Other registries. The block applies only to Identity Digital extensions. It does nothing for .com, .es, .mx or extensions run by other operators.

Variations. It blocks the identical match, not typos or combinations such as “brand-shop”.

Premium names under the legacy version. The Identity Digital help centre confirms that legacy DPML does not block premium names and that no version blocks sunrise registrations.

Other holders of the same mark. A business with an identical mark in another country or class can override the block with its own SMD file. The override itself is free; only the registration fee is paid.

Challenges. Under the dispute policy, anyone can challenge a DPML block at any time while it is active, for example if the mark lacks national effect or the label is not an identical match. The policy sets a provider fee of GBP 250 for up to five names and runs in English.

What this means for your business

Record your core word marks in the TMCH first; it is the prerequisite for DPML and for sunrise access in every new gTLD.

List the Identity Digital extensions you would register defensively and compare that cost with a block.

Choose DPML Plus if your mark is also a dictionary word that registries may classify as premium.

Keep defensive registrations for .com, your ccTLDs in Europe, Latin America and Africa, and any extension you will use.

Monitor variations: claims notices and the TMCH’s ongoing notifications cover more than the block does.

If you need a single plan that combines TMCH records, blocks and registrations by market, our domain name portfolio and brand protection team can map the options and manage renewals.

Where companies get blocking wrong

Believing one block covers the whole internet. DPML covers one registry’s portfolio; .com and country codes still need their own strategy.

Recording a mark that does not qualify. A pending application, or a Madrid registration whose basic mark has lapsed in its first five years, will not produce a valid SMD file.

Letting the TMCH record expire. Without a verified record there is no SMD file to renew blocks or join sunrise periods.

Ignoring shared marks. If others own the same word in other sectors, they can override the block; plan for that before paying.

Recording the mark in the wrong group company. The registrant must match the SMD file, and a mismatch is expensive to correct. Our trade mark team can align ownership first.

Frequently asked questions

Does DPML block my brand in .com or in country-code domains?

No. DPML only applies to extensions operated by Identity Digital, which the company describes as a portfolio of nearly 300 TLDs. Names in .com, country codes such as .es or .mx and extensions run by other registries need separate defensive registrations, other registries’ blocking products or monitoring and dispute procedures such as the UDRP.

Can someone else register a name I have blocked with DPML?

Yes, in one situation. A holder of an identical trade mark with its own valid SMD file from the Trademark Clearinghouse can override the block and register the name. Identity Digital states that the override is free and only the registration fee is paid. If you think the override or the block is unjustified, the Sunrise and DPML Dispute Resolution Policy applies.

What does it cost to get the SMD file needed for DPML?

The SMD file comes with a verified Trademark Clearinghouse record. Paying by card, the TMCH charges USD 155 per record for one year, USD 465 for three years or USD 775 for five, according to its published pricing. The DPML block itself is quoted by registrars and is a separate cost.

Can IP Global Guard record our marks in the TMCH and arrange DPML blocks?

Yes. We check which marks qualify, prepare the TMCH record and proof of use, and arrange the DPML or other blocks through an accredited registrar, alongside the defensive registrations you need in Europe, Latin America and Africa. We coordinate it all from a single point of contact and track renewals.

Build the right blocking strategy with IP Global Guard

A block is only as good as the mark behind it and the extensions it leaves out. IP Global Guard, the IP services line of META Channel Corporation Limited, combines trade mark filing, TMCH records, blocks and domain portfolio management across more than 25 jurisdictions, with one strategy and one billing relationship; see our coverage in Europe, Latin America and Africa.

Tell us which marks you want to protect and which extensions you currently hold.
