Public Consultation No. 02\/2026, published on 8 September 2026, puts four draft texts out for comment for 45 days, until 23 October 2026. Nothing is in force yet.<\/li>\n<\/ul>\n<h2>What has INPI put out for consultation?<\/h2>\n<p>Dated 2 September 2026, the consultation was published in the Official Gazette (DOU No. 169) and the Industrial Property Journal (RPI No. 2905) on 8 September, as <a href=\"https:\/\/www.gov.br\/inpi\/pt-br\/central-de-conteudo\/noticias\/inpi-abre-consulta-publica-sobre-tramite-prioritario-para-di\" target=\"_blank\" rel=\"noopener\">INPI announced that day<\/a>. It covers four drafts:<\/p>\n<ol>\n<li>An ordinance creating priority examination for design proceedings, by amending INPI Ordinance No. 07 of 14 January 2022.<\/li>\n<li>An ordinance setting the modalities of a priority examination pilot project.<\/li>\n<li>An ordinance fixing the quota system and admission criteria for phase I of that pilot.<\/li>\n<li>New guidelines in INPI&#8217;s Industrial Designs Manual.<\/li>\n<\/ol>\n<p>Contributions go only through the form on the <a href=\"https:\/\/brasilparticipativo.presidencia.gov.br\/processes\/tramite-prioritario-desenhos-industriais\" target=\"_blank\" rel=\"noopener\">Brasil Participativo platform<\/a>, article by article. Every co-owner must qualify. Priority starts once the filing is published in the RPI and runs until grant or final refusal, including appeal. It ends if the application is transferred to someone who does not qualify. Decisions on the request cannot be appealed, but a new request with fresh evidence can be filed.<\/p>\n<p>Priority would also cover post-grant merit examinations and administrative nullity proceedings. In phase I, requests are admitted in order of filing; every request counts towards the 500 places, successful or not, and intake stops when they run out. INPI would publish monthly statistics.<\/p>\n<h2>Why does speed matter for designs in Brazil?<\/h2>\n<p>Under Article 106 of Brazil&#8217;s <a href=\"https:\/\/www.planalto.gov.br\/ccivil_03\/leis\/l9279.htm\" target=\"_blank\" rel=\"noopener\">Industrial Property Law (Law 9,279\/1996)<\/a>, a design application that passes the formal checks is published and granted at the same time, without a prior novelty search. The wait is in the examination queue that the drafts now propose to prioritise. Once granted, the registration lasts 10 years from filing, renewable for three five-year periods (Article 108). The owner can request a merit examination at any time (Article 111), and third parties can seek nullity within five years of grant (Article 113).<\/p>\n<p>Foreign applicants can also reach Brazil through the Hague System, in force for Brazil since <a href=\"https:\/\/www.wipo.int\/en\/web\/hague-system\/w\/news\/2023\/news_0009\" target=\"_blank\" rel=\"noopener\">1 August 2023<\/a>, with one design (and up to 20 variants) per application and no deferment of publication. The drafts do not say how priority would apply to international registrations designating Brazil, a point worth raising in the consultation.<\/p>\n<h2>What this means for your business<\/h2>\n<ul>\n<li>Decide by mid-October whether to comment, especially on the reciprocity modality and on Hague designations.<\/li>\n<li>Check whether any modality could fit: pending litigation, marketplace rules or a prioritised patent family.<\/li>\n<li>Gather evidence now: marketplace terms, pleadings, patent numbers, with translations.<\/li>\n<li>Keep filing on schedule. The reciprocity modality depends on agreements the drafts do not identify.<\/li>\n<li>Restructuring at the wrong moment. Assigning the application to a group company that does not qualify ends priority.<\/li>\n<li>Filing incomplete requests. Rejected requests still consume the quota, and translations are required.<\/li>\n<\/ul>\n<p>One coordinated plan, with a local correspondent involved from the start, avoids all four.<\/p>\n<h2>Frequently asked questions<\/h2>\n<h3>Is priority examination for industrial designs already available in Brazil?<\/h3>\n<p>No. Public Consultation No. 02\/2026 only opens draft texts for comment until 23 October 2026. INPI will then answer the contributions and publish the final ordinances, and the pilot will open on dates still to be set. Until then, applications follow the regular chronological queue.<\/p>\n<h3>Could a European company qualify for priority?<\/h3>\n<p>Possibly, if its case fits a modality: court proceedings over the design, a marketplace that formally requires a registered design, or a link to a prioritised patent. The reciprocity modality would depend on an agreement with the company&#8217;s country.
